Terms of Service

By accessing or using Pompter ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform.

These Terms apply to all users of the Platform, including visitors, registered users, and creators (authors who publish prompts).

Pompter is an online marketplace that allows users to create, share, sell, and acquire AI prompts with dynamic variables. The Platform facilitates transactions between prompt creators and buyers.

We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time with or without notice.

To access certain features, you must register for an account. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.

You must provide accurate, current, and complete information during registration. You may not create accounts for the purpose of automated access, scraping, or circumventing restrictions.

Creator Ownership: Creators retain full intellectual property rights over the prompts they publish. By listing a prompt on the Platform, creators grant Pompter a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute the prompt solely for the purpose of operating the Platform.

Buyer License: Upon acquiring a prompt (free or paid), buyers receive a non-exclusive, non-transferable license to use the prompt for personal and commercial purposes. This license does not include the right to resell, sublicense, or redistribute the prompt as a standalone product.

License Persistence: The buyer's license to an acquired prompt survives if the creator later deletes or unpublishes the prompt. A copy of the prompt template is retained for the buyer's continued use under the same license terms.

Platform License: Pompter does not claim ownership of your content but requires the display license described above to operate the marketplace.

Prompts on the Platform may be used with third-party AI services. Pompter does not control and is not responsible for the output generated by AI systems in response to prompts purchased on the Platform.

The quality, accuracy, and appropriateness of AI-generated content may vary. By using acquired prompts, you acknowledge that results may differ from any examples shown and that you assume full responsibility for the use of AI-generated outputs.

You must comply with the terms of service of any AI service you use alongside prompts from our Platform.

You may not publish, sell, or use prompts that:

• Are designed to generate illegal content, including CSAM, threats, or instructions for violence
• Facilitate harassment, discrimination, or hate speech
• Infringe third-party intellectual property rights
• Are designed to bypass AI safety measures or generate deceptive content
• Violate any applicable law or regulation

We reserve the right to remove any content and suspend any account that violates these restrictions.

If you believe content on the Platform infringes your copyright, please send a written notice to hello@pompter.com including:

• A description of the copyrighted work claimed to have been infringed
• A description of where the infringing material is located on the Platform
• Your contact information
• A statement that you have a good faith belief that the use is not authorized by the copyright owner
• A statement, under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the copyright owner

We will respond to valid notices in accordance with applicable law and may remove infringing content pending investigation.

You may not use automated tools, bots, spiders, scrapers, or any other means to access, collect, or index content from the Platform without our express written permission.

You may not reverse engineer, decompile, disassemble, or attempt to derive the source code of any software underlying the Platform. You may not attempt to gain unauthorized access to any portion of the Platform or its related systems.

Paid prompts are processed through Stripe. By making a purchase, you agree to Stripe's Terms of Service. Pompter charges a platform fee on each sale; the remainder is disbursed to creators via Stripe Connect.

All prices are referenced in USD. When displayed in another currency, amounts are converted using estimated exchange rates and may differ from the final charged amount. Payments are processed by Stripe in the selected currency.

Creators are responsible for any taxes applicable to their earnings from the Platform.

Due to the digital nature of prompts, all sales are final once the prompt template has been revealed to the buyer. We do not offer refunds except in the following circumstances:

• The prompt was materially misrepresented in its description
• A technical error prevented delivery
• A duplicate charge occurred

Refund requests must be submitted within 7 days of purchase to hello@pompter.com. We reserve the right to make the final determination on refund eligibility.

The removal or deletion of a prompt by its creator does not constitute grounds for a refund, as buyers retain a copy of the acquired prompt.

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

We do not endorse, guarantee, or assume responsibility for the quality, accuracy, or legality of any prompt listed on the Platform.

To the maximum extent permitted by applicable law, Pompter and its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill.

Our total liability for any claim arising from use of the Platform shall not exceed the amount you paid to Pompter in the twelve (12) months preceding the claim.

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved in good faith or, if necessary, before a competent court of applicable jurisdiction.

We may update these Terms from time to time. We will notify you of significant changes by posting a notice on the Platform or by email. Your continued use of the Platform after the effective date of the revised Terms constitutes your acceptance of the changes.
